An Ejectment is a cause of action brought in a County Court of Common Pleas to remove an occupant from a property who has no right to be there. This type of action is commonly used in the fallout of a mortgage foreclosure proceeding and subsequent sheriff sale where the occupant who once owned the property is still living in it after the property has been sold by the Sheriff.
This type of action is different than an Eviction in that there is no contractual relationship between the occupant and owner of the property such as the case in a typical landlord/ tenant arrangement. In the typical Eviction action, the owner or landlord of the premises would be able to file a complaint in a local magisterial court and have the matter heard and disposed of much more quickly than an Ejectment case.
